Terms and Conditions
Section 1 – Definitions
In these terms and conditions, the following definitions apply:

Entrepreneur: The natural or legal person who offers products and/or services to consumers.

Consumer: The natural person who is not acting for purposes related to their trade, business, craft, or profession and who enters into an agreement with the entrepreneur.

Agreement: Any agreement between the entrepreneur and the consumer concerning the purchase of products and/or services.

Section 3 – Applicability
These terms and conditions apply to every offer, quotation, and agreement between the entrepreneur and the consumer, unless explicitly agreed otherwise.
Section 4 – The offer
All offers made by the entrepreneur are without obligation unless otherwise stated. The entrepreneur is only bound by the offer if the consumer accepts it within the period stated in the offer or, if no period is stated, within a reasonable period.
Section 5 – The agreement
The agreement is concluded the moment the consumer accepts the offer or places an order via the entrepreneur’s website and the entrepreneur confirms receipt.
Section 6 – Right of withdrawal
Consumers have the right to withdraw from the agreement within 14 days without giving reasons. The withdrawal period expires 14 days after the consumer, or a third party designated by the consumer, has taken physical possession of the product.
To exercise the right of withdrawal, the consumer must inform the entrepreneur of their decision to withdraw from the agreement by a clear statement.
Section 7 – Exclusions from the right of withdrawal
The right of withdrawal does not apply to:

Products made to the consumer’s specifications or clearly personalized products.

Products that deteriorate quickly or have a limited shelf life.

Sealed products which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
Section 8 – The price
The prices stated on the website include VAT and other levies imposed by the government, unless stated otherwise.
Section 9 – Delivery and execution
The entrepreneur will take the utmost care in receiving and executing orders. Delivery times are indicative and not binding unless explicitly stated otherwise.
Section 10 – Payment
Payment must be made in the manner indicated by the entrepreneur. The consumer must pay the agreed price plus any costs related to delivery unless otherwise agreed.
Section 11 – Retention of title
The entrepreneur retains ownership of the products delivered until the consumer has fulfilled all obligations arising from the agreement.
Section 12 – Guarantee and complaints
The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, reasonable requirements of reliability and/or usability, and the statutory provisions and/or government regulations existing at the time of the conclusion of the agreement.
The consumer must inspect the products immediately after delivery and report any defects or shortfalls to the entrepreneur without delay, but no later than within 7 days after discovery.
Section 13 – Liability
The entrepreneur is only liable for direct damage suffered by the consumer resulting from an attributable failure in the fulfillment of the agreement. Liability for indirect damage, including consequential damage, lost profit, and lost savings, is excluded.
Section 14 – Complaints procedure
If the consumer discovers defects in the performance of the agreement, they must notify the entrepreneur clearly and fully within 7 days of discovery.
Upon receipt of the complaint, the consumer will receive a response within 14 days. If more time is required to handle the complaint, the entrepreneur will send an acknowledgment of receipt within this period, indicating when a substantive reply can be expected.
If a complaint cannot be resolved to the satisfaction of both parties, the consumer has the right to escalate the issue to an independent dispute resolution body, if applicable, or to seek legal remedies.
Section 15 – Dispute resolution
The agreement between the entrepreneur and the consumer is governed by the laws of Netherlands
In case of a dispute, the parties will first seek an amicable solution. If no solution is found, disputes may be submitted to the competent court or an independent dispute resolution body.
Section 16 – Final provisions
If any provision of these terms and conditions is invalid or void, the other provisions will remain fully in effect.
The entrepreneur reserves the right to amend or supplement these terms and conditions. The most current version can always be found on the entrepreneur’s website.
